I am having trouble with Capital One credit card company. I applied for a card with them last June and cancelled the card in January after receiving numerous unauthorized charges to my account and an unauthorized card that was charged and sent to a friend’s address (not even my address so that I would know that I had an additional card). After closing the account, I have continued to receive charges to the card and requests for payment. I have written to the company enclosing copies of their acknowledgement of my closed account. I have called them several times and been “hung up on” when I refused to give my current information. This company is becoming a nightmare for me. Can you advise me on how to sever my ties to them safely and completely? Have you received other complaints about this company?

Cap One has a stupid policy of keeping your account “open” for as long as 6 months after it was closed. And if a charge goes through after the account is closed, that effectively re-opens the accounts. Like I said, it’s a stupid policy.

You need to claim fraud with Cap One immediately, if someone else is using your card w/o your permission.

You need to contact the police about this fruad and generate police reports.

After all this you will still have to fight hard to get the charges removed. Cap One is tough to.

But this will help. Go to www.planetfeedback.com, register, and write Capital One Financial (c/o Richard Fairbank) with a complaint. Within a week, you will get a letter or phone call from them referring you to the Consumer Advocate’s office. If you don’t immediately hear from them, keeping writing letters via PFB and you will eventually. Or you can call customer service and demand to be transferred to the Executive Offices. I guarantee you, that if you talk with the Consumer Advocate, he will help you out of this mess.

Be clear, thorough, and angry. After all, these are not your charges. Be angry that Cap One would allow any charges to be posted after the account was closed by them.

I recently had an unauthorized charge from a Sears store. After talking with Mastercard, they put a “hold” on the charge until they could investigate and get a copy of the charge receipt from Sears. It came back with my signature forged (a fairly decent forgery but not perfect). My wife and I have never even been to the city where the Sears store is located, plus we rarely use Sears at all. Mastercard says sorry, I will have to pay the $112.80 charge because “it appears to us to be your signature.” I guess I have to pay it to avoid a bad report to the credit bureaus from Mastercard, but this seems grossly unfair since it was not our charge but a clever attempt (obviously successful) at forgery. Do I have any other choices than paying the charge under protest and cancelling the card (a foregone conclusion since I am getting charged for something I did not do). I have had this card for 15 years and have never missed a payment. What happened to loyalty? The card companies want it, but do they give it?!!!

Try to provide as much evidence as possible that the charge was not yours. The signature is the best way to go about it. Of course, if you can prove where you were during the time of the transaction, that may help, and get some witnesses to back-up your end of the story, with signed letters.

I learned the hard way to pay stuff and argue later. It’s a shame but that’s the way it is. I ended up with a derogatory public record after a dispute which I refused to pay. Then had to pay it anyway.

Forgery is a felony. I would contact your local District Attorny’s office and ask how to proceed with filing a complaint.

Can you prove you were at work, church, school, another store in another state (city) at the time?

Did you call long distance that day from home?

Did you get a phone call at home that day from somebody?

TECHNICALLY YOU REALLY DON’T HAVE TO PROVE ALL THIS…THEY HAVE TO PROVE YOU WERE AT THAT STORE AT THAT TIME AND SIGNED YOUR NAME!!!

Does it make it more difficult to argue later because “Why did you pay for it if you claim it’s not yours?” I thought if you pay, you admit the charge was yours, or that you give up your rights to dispute. That is why you should not transfer disputed balances (I am sure), or pay them off (NOT sure anymore).
