Post subject: Unauthorized Credit Card Charges

I recently had an unauthorized charge from a Sears store. After talking with Mastercard, they put a "hold" on the charge until they could investigate and get a copy of the charge receipt from Sears. It came back with my signature forged (a fairly decent forgery but not perfect). My wife and I have never even been to the city where the Sears store is located, plus we rarely use Sears at all. Mastercard says sorry, I will have to pay the $112.80 charge because "it appears to us to be your signature." I guess I have to pay it to avoid a bad report to the credit bureaus from Mastercard, but this seems grossly unfair since it was not our charge but a clever attempt (obviously successful) at forgery. Do I have any other choices than paying the charge under protest and cancelling the card (a foregone conclusion since I am getting charged for something I did not do). I have had this card for 15 years and have never missed a payment. What happened to loyalty? The card companies want it, but do they give it?!!!

Bill,
Try to provide as much evidence as possible that the charge was not yours. The signature is the best way to go about it. Of course, if you can prove where you were during the time of the transaction, that may help, and get some witnesses to back-up your end of the story, with signed letters.

I learned the hard way to pay stuff and argue later. It's a shame but that's the way it is. I ended up with a derogatory public record after a dispute which I refused to pay. Then had to pay it anyway.
Forgery is a felony. I would contact your local District Attorny's office and ask how to proceed with filing a complaint.

Can you prove you were at work, church, school, another store in another state (city) at the time?
Did you call long distance that day from home?
Did you get a phone call at home that day from somebody?
TECHNICALLY YOU REALLY DON'T HAVE TO PROVE ALL THIS...THEY HAVE TO PROVE YOU WERE AT THAT STORE AT THAT TIME AND SIGNED YOUR NAME!!!

I learned the hard way to pay stuff and argue later.
Does it make it more difficult to argue later because "Why did you pay for it if you claim it's not yours?" I thought if you pay, you admit the charge was yours, or that you give up your rights to dispute. That is why you should not transfer disputed balances (I am sure), or pay them off (NOT sure anymore).
