I paid my credit card (Chase) off in July. I made no new chages. I forgot I had paid it off & sent them another check for the balance ($6,300.) I have repeatedly asked them to refund the money & they refuse to do it. They keep asking me who to make the check out to & where to send it. They also told me it had been approved & the next time I called they said the check was in the mail I called again a few days ago & they said they wanted to know where to send it & what name to put on the check. I told them again that either my husbands name or mine was fine & to send it to the same address where they used to send the bill. I also got very angry & told them off. I really need the money to pay my property taxes. What can I do to make them give it back? [/b]

What happened to the overpayment? Does it show up on the Chase statement as a credit? You should be able to work this out with them but it may take a few weeks. The law probably allows them to drag their feet and do their “who me?” Alfred E. Neuman imitation.

What continues to baffle me is why Chase and other credit card companies are so anti-consumer, and so dense. You sound like a good customer and they treat, even you, like crap.

I’ve mixed it up with Chase and found them to be the most profoundly, deeply stupid, sadly retentive, slightly amusing, sitting-on-the-potty, worst excuse for a bank.

After three weeks you need to notify the bank regulator, FTC, state attorney general and anyone who will listen. If Chase cashed the check what did they do with it?

The problem is that state or federal law may actually allow them to take their time in getting this errant over-payment back to you. Having been through some small claims disputes, getting back an overpayment may take months.

But I want to believe Chase isn’t that stupid, like I want to believe the wizard will finally give me a brain - or maybe, a brain stem - or anything that will enable me to crawl out of this drainpipe and evolve into a higher form of credit life, to crawl, and evolve, take huge risks like breathing without gills, and finally circle the Chase Headquarters on my knees in complete submission and, yes, even gratitude.

Ok, time to roll out the big guns here.

Write a letter to Chase and send it certified mail, return receipt requested. Stte your case, but make it totally factual. Reread your letter befor sending it and if there’s anything remotely emotional in it, reword or delete that section. If possible give them dates - dates of statements, dates that you called, details of responses, names of who you spoke with if you happened to make a note of them, etc.

Finally, make a calll for action. State it very simply, and outline what you will do if your demands aren’t met.
for instance……

“Unless I receive your refund check within 30 days of the date of this letter (put in the exact date if you like), I will send copies of this correspondence to the Attorney Generals of (your state and the state where your statements come from), the State Bank Commissions of (same thing, your state & theirs), the Federal Trade Commission, the Better Business Bureaus of (your city & theirs), etc.

“I await your prompt response.”

If 30 days go by with no response, do exactly what you told them you would do, and send copies of your letters to customer service. However, you might be surprised at how fast you get action. Trust me, they do NOT want government investigations, and every agency you write must by law investigate all legal complaints.

If Chase has 6300 of your hard earned money collecting interest .. A suggestion would be is to call them and tell them that you are going to the bank and writing an access check out for 6300 and for them not to charge you a transaction fee.. If you do not have access checks, other options to get your money quickly are to do over the counter cash advance with no fee or to have the bank to a wire to wire. transfer … If you did have a balance that was revolving a balance and your payoff check came midway throught the billing cycle, they may be waiting for the current billing cycle to end and subtract the finance charges for the month before sending the check…

Don’t be nice about your money, it is your money if you owed them they’d be ready to screw your credit and sue Chase is developing a wicked reputation and they are making good money from your money They know they owe you and are gonna hold this money until you raise cain :idea:CUT THE CHASE, Don’t write an a check because they are gonna charge you (so-called computer glitches) It is reasonable enough to fedex these bad boys a letter of demand and tell them if they don’t come across with your money within the next 15 days you are going to sue their collective @#$#@ for interest and any liquid damages and atty. fees Tell them to send it over night express as they have had your money long enough to pay for it Good luck and be rid of Chase

What you should do is contact your bank which the checks where made out from… and request photo copies front and back of both of the checks that had been written to Chase!!!

Send that to them, in your dispute letter…

Also, there is a reglatory company wich over sees them like FDIC or some sort for you to locate and file complaint against them specifically. Include them in the companies you are contacting to resolve this matter.

Businesses that offer “open end” credit also must:

promptly credit or refund overpayments and other amounts owed to your account. This applies to instances where your account is owed more than one dollar. Your account must be credited promptly with the amount owed. If you prefer a refund, it must be sent within seven business days after the creditor receives your written request. The creditor must also make a good faith effort to refund a credit balance that has remained on your account for more than six months.

Do this crrr to have proof that you requested a refund. They have 7 days to get this back to under FCBA.
