Post subject: DOUBLE REPORTING ON CREDIT REPORT

Dear sirs,
I’m on total didability and am repairing my credit.
I upset the local credit reporting agency. They had stuff on there that was reported by mistake from U of M, they wrote them two letters saying it was paid and reported wrong to them. Well ten years later they finally took it off as they were sueing me for all the stuff on my report and told all the people I was trying to work with not to talk to me. I went to court and told them I owed these medical bills and was trying to work it out in payments. They got there judgement for all the bills, but now on my credit report they list all those in the judgement as one name and leave the other hospitals as seperate making it look like I owe twice as much as I do. In other words they got four hospitals list as one doctor’s name owing $800 then they have the three not under the doctors name list as owing $600 more. Therefore making it look like I owe $1400 in debt, when really the total debt on my credit report is $800. They claim that it is legal to do it that way because the court has the judgement only under one name the first doctor. Is this right it like double jepordy.

This is not a reply but a furtherance of support. I defaulted on one card to AMSouth. They sold the bad debt to Midland Credit Management. Midland now also reports the debt as a write off/collection account. It does give the appearance of two bad debts. Any information would be helpful.

Who claims it is legal to do this? The doctor or the Credit Reporting Agency? I know this kind of double reporting happens alot with collections and charge-offs that get sold to other collection agencies and it is illegal in that situation. I would imagine that it is illegal when it comes to judgements as well.

Cross Country Bank recieved a bankruptcy from a lady that has the same first and last name as my wifes, but middle name is different as is the SSN#’s. Plus we filed chap. 7 in 1997, so we wouldn’t be able to file this year or for awhile at least, but they(CCB) putit on my wifes card and not hers and now they won’t take it off is there anything we can do we don’t have alot of money to fight these guys.

Did you talk to them directly? You might have better luck formally disputing the item with the credit reporting agencies.

I would recommend that you get in touch with the OCC (Office of the Comptroller of the Currency) and file a complaint. It won’t cost you a cent. Send a copy of your complaint to the bank (at their correspondence, not billing, address) and be sure they are aware that you have complained to the OCC.

You should get some action.

I wrote a letter to National Credit Systems, which they received registered mail on September 25th. I have not heard anything back from these people and this is a big problem as we are trying to buy rental property and with this collection on my credit report it makes things difficult.
When I called they said it was under investigation and would not answer any of the questions that I had requested answers to.
I don’t feel that this is correct information on my credit report, but if they won’t give me any of the information in regards to this account, how can I do anything about it?
Please help.

You always have the option of sending a 100 word statement to the credit bureaus with regard to a specific item which you believe is not being reported properly for whatever reason. Your statement should indicate why you believe that the charge is incorrect and that you mailed your story to the company on such and such date and have received neither acknowledgement or receipt from the credit card company. By law the credit reporting agencies MUST include your statement when they send your credit history to a prospective creditor.

I don’t feel that this is correct information on my credit report…
Write to the credit bureaus (not only to the creditor) and dispute the negative information with them. They will be able to remove the negative entry if the creditor cannot prove it is right.
With all due respect to Ira, do not rush into submitting this 100 word statement. It might be a good idea if you would not be able to remove the entry, but it does not do much good because most creditors calculate the score automatically, and your note technically cannot be included in this score. I look at it this way - if you feel you are right and the negative entry is wrong, insist on removing the negative info. If you were wrong to pay late or whatever, a note saying “I was late, I am sorry, it will never happen again” will not do you any good.
