Post subject: Concering Credit Card Harrassment in Texas

My friend has a Compass Bank Account and Credit Card, well she has gotten behind and did not pay for like a few months, but paid recently something, anyways, they cut off her atm card, can they do this? The big ? is the CC company called one of her neighbors and it is someone she does not even know, never even met, and left them a voicemail to please go to their neighbors house and have her call Compass Bank, blah blah, omg, can they do this? We live in Texas. The lady they called was nice enough to come but how embarrasing, I would think there is some kind of privacy act or something to protect you from a CC Co. going to the extreme of finding someone with an address close to yours and asking them to go to your home, etc? Thanks so much! I so appreciate the help!

I think unless she brought the account back current, they they would have a right to refuse the ATM usage... after 6 months of none payment, the account would be charged off and closed, maybe sooner... they might have already closed the account on her and that is why the ATM card is not working. They can call neighbors, but they are limited by law as to what they can talk about with such 3rd parties... they are not suppose to disclose the reason for the call, or that it involves a collection...

You can read more here at the FTC site: ftc.gov/os/statutes/fdcpajump.htm

Top link on left - pdf file is the Fair Debt Collection Practices Act, and it will explain more about 3rd party discloseures.

Thank you so much! Wow can't believe they can harrass others by calling them. If someone called me and asked me to go to my neighbors I would be furious and no help! Its bad enough that we get all kinds of telemarketers calling, lol! Thanks again!
