Yes, got your e-mail, sorry about the lost post on the tax liens will get back to you to see what we can do to recreate the post and links that were lost.

Actually my post was about FNBO and CreditMember Services verifying for a out of business OC FCNB.
Do you remember you saying you were going to look into it?

Ah, you are really testing my memory.
I know if it is a company that has gone out of business you should be able to dispute that it is not yours, then when the creditor does not respond to the CRA it should come right off.
Unless you are the one asking about Master Trust taking over the original creditors account. If it is that one, give me time get to work to hunt down the address again for you.
Think also suggested that you send them debt validation letter, since if the original creditor is no longer around. Likely they should not be able to validate the debt with you - unless they pulled a rabbit out of the hat.
Have to excuse me if I got that wrong... I know on a daily basis I talk to sometimes 10 to 30 people a day home and at work about credit. My recall is not the greatest unfortunately.
If you can fill me in a bit more so I might have a better direction to work with.

Are you the one I was going to drop a call on a creditor to check on to see who they are affiliated with? I don't have that number if that is the one, I should of moved quicker and forgot - boy now you got me going - be thinking all day on this one.

Also if you can remind me a bit more on what I was going to be checking exactly for with them.
Need full company names, I am not good with abriviations... look at too many of them everyday on credit reports and it is all just info that goes right by unless I have a specific reason to know a certain one, it usually eludes me after I finish a project and move on.

Alright...this is pretty much the whole trail:
I have a CO FCNB TL on all 3...both TU and Exp verified!
Now here's where it's gets interesting: Experian has the address as:
FIRST CONSUMERS NATL BK (Still listed this way on Experian)
Address:
9300 SW GEMINI DR
BEAVERTON, OR 97078
They're out of business. Stupidly, I didn't 1-2 because I thought it would fall off like Spiegel and another FCNB.
Now when I pulled TU again I saw the address as:
FCNB MASTER TRUST/SERVIC
C/O FNBO 1620 DODGE ST
OMAHA , NE 68197
Can First National Bank of Omaha list as an OC? Is that legal?
I think FNBO verified with Exp as FCNB although Exp has the old address as opposed to FNBO's.

This explains everything...CardMember Services is reporting as FCNB on TU and FNBO is reporting as FCNB on Exp...
You think I should just validate them and call them on reporting as an OC when they are not? Is there any letter out there that addresses this?

They are a collection agency no matter what they say, just for the fact that they are not the original creditors.
This is not the first time, Capital One has been doing the same!!! Buying debt - then trying to offer a new credit card in exchange for paying what was owed on the account they bought up form another company.
Though I doubt Master Trust is doing that, but they have like Capital One took over ownership of another companies account. I don't likely know if it is legal or not, had not seen anyone as of yet take Mast Trust to account for their actions as of yet. They had in the past been dealing with Hileg Meyers (also out of business) but it is false and misleading what they are doing for sure to report under another companies name when it is known that company went out of business - I look at it as intrapment what they do.

I was also dunned by Platinum Recovery Solutions...guess what their address is: 1601 Dodge St. Omaha, Nebraska...I guess they have their own Capital One/Westmoreland setup.

What you have is a company like this one:

They are one company using multiple DBAs on purpose to hit your credit report & swap ownership each time they are sent Debt Validation to exhaust you.
What you do is just send out DV to each one you get correspondence from, there is just not going to be a way to keep up with who has the account. It is a shell game of theirs. It is really two bad to realize now that their are more collection agencies out there then Shermans doing this.

But how do I DV them? If I send proof back to the CRA that they haven't validated they'll just say "...the company you're requesting validation from is not the one listed on your report".
Catch 22 don't you think?

If you look in this same section you will see a post titled: Class action Suit v Sherman Acquisitions; this company is the forerunning for playing this same exact game with consumers! They likely have 4 or more DBAs they are running with.
This problem might take a bit of creativity to bring down... I am not particularly good at explaining debt validation and the such. I am going to bring in some help on your problem here - see if Sis will weight in on explaining what you need to do to deal strongly with the CRA & CA.

You can try a letter like this, you will want to modify it so that it is a first letter and not a follow up. I had really good results with this one and so did a few others that I know of. I would only send DV letter to the CA listed now, leave the rest alone and wait and see what happens here.

I am formally requesting that you validate all tradeline notations you have submitted to the three major credit reporting agencies under {ca} for {name} account # xxxx.
Due to inconsistencies and possible inaccuracies in all three of these credit reporting agency’s reports, I must demand that the validation I hereby lawfully request be in the form of a notarized statement by a person with original knowledge of the debt as it was constituted and who can testify that the debt was incurred legally, was not subsequently disputed as a result of returned, faulty, or recalled consumer products, was not utilized as a profit-loss tax deduction during the period it may have been payable, and was not claimed as a loss with any insuring entity during the period it may be been payable. Please be advised that I am not requesting a verification that you have my mailing address; rather, I am requesting validation, i.e., competent evidence that I had some contractual obligations sans consumer protection encumbrance with incurred the original claims associated with this tradeline.
I had no knowledge of any outstanding balance due your company and was very shocked to learn that there was a negative listing on my credit reports with a $xx balance due along with erroneous previous payment history entries. I requested formal validation of this debt to your company on xx/xx/xx. The reply I received was from your collection agency, (insert ca) (insert time frame) later.
Reporting such invalidated information to the credit bureaus might constituted as defamation of character, as the negative marks on my credit report harm my credit and prevent me from receiving fair analysis by other potential companies offering extensions of credit. I demand that you delete the listings on my credit reports, and I’m sure your legal staff will agree that non-compliance with this request could put you and your collection agency in serious legal trouble with the FTC and other state and federal agencies.
Your company knew or should have known that the actions taken against me and the information collected about me were inappropriate and damaging to me. Your company has failed to use reasonable care in the course of business and failed to use even minimal procedures to ensure that I was not harmed. You have communicated and are continuing to communicate incorrect and defamatory information to Equifax, Experian, and TransUnion. Please understand that I am extremely concerned regarding the harmful resultant consequences of the actions of your company has taken. Please be advised that, if this matter is not resolved expeditiously, I will take any and all necessary steps to protect my rights.
If you wish to resolve this matter, this is your last opportunity to do so. All tradelines involving this account must be deleted from my credit files with the three major credit bureaus are to be deleted within 5 days from the tracked and verifiable receipt of this letter. Forward a letter to me via facsimile and via regular U.S. mail stating that the tradelines have been removed and will not appear on my credit reports again. I will accept nothing less.
Please be aware that if these accounts are not handled in this manner, I will file a formal complaint with the Federal Trade Commission, my state and your state Attorney General’s offices, and the Better Business Bureau. Also, note that section 1681s-2(b) of the Fair Credit Reporting Act creates a cause of action for a consumer against a furnisher of erroneous credit information (Nelson v. Chase Manhattan).
For the purposes of 15 U.S.C. 1692 et seq., this Notice has the same effect as a dispute to the validity of the alleged debt and a dispute to the validity of your collection agencies claims. This Notice is an attempt to correct your records, and any information received from you will be collected as evidence should any further action be necessary.
